Terms of Service

Who we are

HeyNailSpa (the "Service") is an AI receptionist, appointment and customer-care application for salons, operated by TK AI Solutions LLC, 2333 Devonshire Dr, Lincoln, NE 68506, USA ("we", "us"). By signing in to app.heynailspa.com, installing the app, or forwarding your business line to a HeyNailSpa number, you ("you", the "Salon") agree to these Terms. If you signed a Service Agreement with us, that agreement controls where it differs from these Terms.

Your account

Accounts are created by TK AI Solutions for a specific salon after set-up. Each login is for that salon and the people who work on site. You are responsible for keeping your password confidential and for everything done under your account. Tell us right away at the contact below if you believe someone else has your login.

Your license to use the Service

During your subscription we grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for the day-to-day operation of your own salon. We own, and keep, all rights in the Service, including its software, design, AI receptionist prompts and scripts, voice and call flows, configurations, documentation, and the HeyNailSpa name and logo. Nothing in these Terms transfers any of that to you. Suggestions you give us may be used by us without obligation.

What you may not do

• Copy, modify, translate, decompile, reverse engineer or otherwise try to discover the source code, prompts, scripts, voice configurations or workflows of the Service
• Share, sell, lend or publish your login, dashboard link, API key or AI telephone number so that anyone outside your salon can study, record, test or replicate the Service
• Use the Service, or any recording or transcript of it, to benchmark, train or build a product or service that competes with HeyNailSpa
• Access the Service by automated means (bots, scrapers, scripts) except through features we provide for that purpose
• Remove or hide any HeyNailSpa name, logo or notice, or present the Service as your own or a third party's product
• Use the Service to send messages or make calls that violate the TCPA, carrier rules or any applicable law

If anyone asks you for access to the Service or for a description of how it works, please let us know. We may suspend or close an account immediately, with notice to you, if we reasonably believe this section has been breached, and we may seek an injunction and any other remedy available under U.S. federal and Nebraska law, including the Defend Trade Secrets Act (18 U.S.C. § 1836).

Your data and your customers' data

Data about your customers collected through the Service belongs to you. We process it only to provide and improve the Service for you, as described in our Privacy Policy. Text messages to your customers follow our SMS Terms, and you are responsible for collecting the consent those terms describe and for the information (hours, services, prices, staff) you give the AI receptionist.

AI receptionist

The receptionist is an automated system. It can mis-hear or mis-state information. You remain responsible for confirming appointments with your customers and for anything you ask it to say. We do not guarantee uninterrupted service or approval of any phone number or messaging registration by carriers or platforms.

Fees, term and termination

Fees are those of the plan you selected and are billed through Stripe. Either side may end the subscription at the end of the current billing period. We may end it earlier for a breach of these Terms. On termination we stop answering calls on your HeyNailSpa number and you stop forwarding calls to it; the sections on our ownership, what you may not do, and limitation of liability continue to apply.

Disclaimer and limitation of liability

THE SERVICE IS PROVIDED "AS IS". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES AND ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES OR LOST PROFITS. OUR TOTAL LIABILITY TO YOU WILL NOT EXCEED THE FEES YOU PAID US IN THE THREE (3) MONTHS BEFORE THE CLAIM.

Governing law

These Terms are governed by the laws of the State of Nebraska, USA. Disputes will be brought in the state or federal courts in Lancaster County, Nebraska. We may update these Terms; the date at the top shows the latest version, and continued use after an update means you accept it.
